Strauss Malk & Feder Obtain Big Jury Verdict for Client

Strauss Malk & Feder’s litigation team prevailed in a jury trial against a national insurance company in an insurance coverage dispute case. Following a week-long trial, we recovered not only the full amount of our client’s loss, but also their legal fees, court costs, and statutory damages.

The case arose from a catastrophic loss that our client suffered to their home and contents from a severe weather event which occurred while they were away from their home for the winter. Our client promptly filed a claim with their insurance company, but the company denied the claim in its entirety, using a policy coverage exclusion as an excuse for refusing to pay their claim. We then sued the insurance company for wrongful denial of the claim. After hearing the evidence, including expert testimony, the jury entered a verdict in favor of our client for the entire amount of their loss. The judge then also found that the insurance company’s denial of coverage, as well as its defense of the lawsuit, had been vexatious and unreasonable, such that the court awarded our client their attorneys’ fees, out of pocket litigation costs, and statutory damages, in addition to the damages awarded by the jury for their actual loss.
