Strauss Malk & Feder’s Litigation Group succeeded in defeating an attempt by commercial vendors to prevent their eviction from a mall in a highly publicized politically charged property redevelopment dispute. The plaintiffs argued that they were tenants who could not be evicted on short notice from the mall following the mall’s sale rather than licensees whose licenses to operate in the mall could be terminated at any time. Following a hearing on the plaintiffs’ motion for an emergency temporary restraining order, the court rejected the plaintiffs' arguments about their alleged rights to remain in the premises despite having received notice from our clients of the termination of their licenses. The plaintiffs then agreed to dismiss their claims against our clients.
